A friend was in a one vehicle accident and was driving with only a permit(illegally because no one else was in the car). The accident was caused by another driver who broke the law by being on the wrong side of the road. My friend never collided with the other car but swerved and hit a gaurd rail. There is damage to the car, which only has liability insurance. If the other drivers insurance company denies the claim against the driver on the wrong side of the road or only pays in part, can she sue the driver directly in small claims court for the damage? Will she be successfull? This is in PA. Two witnesses stopped who corroborate my friends statements and there was no speeding or other factors at work.
Yes, she can sue the driver. The insurer will not offer even a partial payment without a release and the release will prevent the suit. If she rejects the release she can sue the driver. The insurer will defend and will pay any judgment. Whether your friend will win cannot be known because there are too many variables.

01/14/05 my daughter was kidnapped out her job site where she worked as a teachers aid. then the next day 01/15/05 the LAPD came incontact with suspect & my daughter,got suspect out the vehicle at gun point,allowed him to somehow run back to the car where they "say they heard gun shots but opened fire on the vehicle 43 times striking my daughter in the head.my daughter left behind four children.me "the mother & clearly the executor of her estate have been horrased by lawyers fromn the board of education in regards to my gardianship.after i disagreed with my attorney making settlements without my knowledge & permission,she then went to partial gardians of two of my daughters children,granted them executor of my daughter to make settlement with board of eduacation & persue lawsuit towards LAPD.my present attorney admitted to making arrangments & agreements with her creating a conflict as well.im writing letters to the bar association requesting displinary investigation,what else now?

It sounds like your attorney may have acted negligently. If this is the case then you are doing the right thing contacting the bar, but they have their limitations. You need to seek another attorney.
The statute of limitations for wrongful death in CA is 1 year, with exceptions. Hopefully your attorney filed and preserved your rights.
The guardianship is a completely different issue and I’m unclear what this entails. Why is the Board of Education contacting you about guardianship? They should not be in contact with you, but should be contacting your attorney.
I would also look at the CA bar website to see if your attorney has had any other complaints. Find another attorney and WRITE down everything you can think of that your current attorney has done to foul up this case.

Who is the most abrasive, hardest hitting Attorney with the best track record?
i would search the American Bar association website / check into the complaints section of lawyers that have clients that are taking action against them. you can eliminate the ones you do not want. maybe try searching for largest personal injury settlements in Seattle ? to find a first list and then compare it to the lousy lawyers that screwed clients on ABA that are in action taken or complaints against their licenses to practice.

I am more inconvenienced by the time it takes to go to the doctor’s office, getting auto estimates, trips to physical therapy, and looking around for medical supplies for my pain. I could have used this time to be with family, work on my business, or teach adjunct at a local college. How do I quantify this ($) when making a claim? I am on summer break (teacher) so it did not affect wages.
Im an insurance agent and former insurance claims adjuster… If you were not at-fault for this accident the claimants insurance company should offer you a settlement offer for your injuries and suffering [the suffering is what we in the insurance world consider what you may call inconvenience] Before you accept a settlement offer for your injuries make sure you let the claims adjuster know that your time as been convinced as a result of their customers negligence and you would like to be reimbursed. They should offer you another $500 to $1k.

I know it takes awhile to move things through courts but I swear he seemed more for the other side than us in our wrongful death suit of our daughter.
Legal malpractice. Not sure what state you are in. laws vary from state to state. here in NC, I had one legal malpractice case. We settled it.
Lawyers usually carry liability insurance so there is money to go after. In NC, you have to prove that you would have prevailed in court on the underlying claim. In other words, just the lawyer not doing what is reasonable is not enough. You have to prove that you would have won the case had he done the reasonable thing.
You can consult an attorney about it. Try to find one in another city- probably not where you live since a local lawyer won’t want to sue another one. And find an attorney with experience in legal malpractice.
Is the wrongful death case over? I know the court system is slow and it’s frustrating. I don’t know from your post that it is the lawyer’s fault though.
And people often only see their side of the case- they don’t see it as a judge or jury might see it. Sometimes people need a lawyer to point out to them that other people may see things differently. Many jurors have been brainwashed by the insurance companies that lawsuits are frivolous and that people shouldn’t sue, so there is a lot of bias against plaintiffs.
I don’t know the details of the case, so I can’t comment on it.
