my daughter was involved in an accident in which she was hit from behind. The other driver was at fault and admitted it and a police report was filed. Since the accident was minor she never pursued a claim. Is there a time limit for filing a claim? It has been about 6 months since that happened. I would like for her to get the car repaired.

Not to answer your question, with a question….but why did you wait so long??…Also, IMMEDIATELY contact YOUR insurance company, and ask them, about any statutes, of limitation, for claims, regarding your OWN, coverable insurance.
Your insurance company, itself, may have a deadline, to file a claim, but you should be o.k., as far as sueing the offending party, for damages….
Many insurance companies, give policyholders, a LIMITED amount of time, to file a claim….because…a fender-bender, 6 months ago, is hard to determine, if the car has been hit, or damaged, since then…they don’t want to pay any more, than they have to…..I don’t blame them, but you should report ANY accident/fender-bender, IMMEDIATELY….along with any police report.

Hi! I was wondering if insurance companies raise your rates based on the number of claims you have total (traffic accident or non traffic accident) or do they primarily look at the claims you have in the last 3 years from traffic accidents. I have a friend that have filed 2 claims for vandalism, 1 claim for over running the curb while parking, one for windshield glass from flying rock on the highway, and one from being hit by another car That’s 5 claims in the last year. Now she recently backed into a fence. ( No she was not drunk or anything- she dont drink nor use drugs) She is worried about whether her rates will go up for filing too many claims, or is it mainly the traffic accidents that she needs to worry about. Anyone can have a fenderbender at home, every now and then. Anyone have any information on how non traffic accidents affect insurance claims? Thanks!

Honestly, her company is probably already looking at nonrenewing her, even before she files the next at fault accident (the curb accident is at fault & the fence accident will be too - the other car one could be depending on the circumstances) - unless she has Progressive, then she will be charged a whole lot more on her next renewal.
I have one company that will change tiering (charge more) after only 2 comprehensive losses (which are the vandalisms & the glass losses).
She has 2 collision losses & 3 comprehensive losses. If she is not with Progressive or other nonstandard carrier now, she will be…

Imagine 100 applicants competing for a position that starts at 40k and requires a law degree. That’s 40k before taxes and student loans payments, which can be $1000 a month for some people. There are lawyers who can easily pay that, but most can’t.

He also hasnt collected 3 other checks from the person we sued. He said he was holding them for accounting purposes. now the one check dated last April may not be good.
Now he sends a bill for another $800 for trying to collect for us. Ps. There was a bartender with no liscense we sued and he hasnt begun to pay either even if court ordered.
we were under the Indiana dram act when we sued because she left the bar and she was also underage( 1 month shy of being 21) We know she did wrong but we went after this bar because of other kids who were served there being under age and having accidents. She was the first to be killed.

If you think that your lawyer was unethical you can contact the state bar. Make sure to request copies of all letters from or to the lawyer, including the transmittal letter for the check. The check can be reissued, but the delay is the big issue. Its really difficult to collect against an individual. Some attorneys will only collect against an insurance company or corporation. If you had a judgment, then you could garnish wages (if he had a job), attach personal property, etc. However, this is a very time consuming process and would likely result in little or nothing of monetary value. I am truly sorry about your daughter. I think you need to talk to the attorney and explain your issues with him.

Are you sure you want to be a personal injury lawyer? That profession is a cesspool. Not only the people you deal with, but your co-workers. Most (not all) personal injury lawyers are the lowest of the low…the absolute scum of the Earth who prey upon innocent people to legally steal money (by suing) and get away with it. It’s absolutely disgusting.

With that being said, you can major in anything you want….philosophy, history, english, business. It doesn’t matter. Your best bet is to go to a recognized university, do very well, graduate, and apply to law school.

with the type of injuries you noted=soft tissue, also known as "whiplash", this is not permanent and "usually" does not carry a lot of value; i know you don’t want to hear that; i would not go shopping or spend "anticipated" settlement money until they make an offer.
