what are the contractual ramifications

You can always fire the attorney. If you get another attorney, and a settlement, the first attorney and the second will hash out how much each gets of your settlement assuming this is contingency based.

My friend was riding his bicycle. He got hit by a car. He is in the hospital now. Should he pick a general personal injury lawyer in his hometown? Or should he pick a personal injury lawyer who specializes in bicycle injuries even if the lawyer lives hundreds of miles away?

Actually the local bar association can give more help with this. I would recommend one who specializes in his type injury first off. Avoid one who overly advertises but instead has a good reputation with the bar.

A good lawyer requires some research.

When we filed for bankruptcy last year, our bankruptcy attorney asked us if we had any pending lawsuits. We replied with a yes, as I had to hire a personal injury lawyer cause of a car accident we were in. We were forced to get a lawyer because of the extensive medical bills…the insurance company of the at-fault driver refused to pay any of our bills…my medical bills were over $25,000 & growing with my treatment and Dr’s. didn’t know when I’d be finished receiving treatment. With us already paying some of the bills out of pocket, it got to the point were forced into bankruptcy….there was no other way. We were told by the trustee and our bankruptcy lawyer that all monies received from the personal injury case would have to be applied toward the creditors in the bankruptcy. So in the end…these are the figures…
P.I. lawsuit total: $46,000+.
P.I. lawyer got his cut: $17,000+.
Leaving $29,000+ to creditors. Could we have lied & gotten all of the $29,000 w/out getting caught

Probably not. Forgive me for sounding Biblical, but be sure your sins will find you out. It’s karma… what goes around, comes around.

Seriously, there is probably 100x more in Florida than any other state I’ve ever visited. I am guessing that the state is either plaintiff friendly or the laws are more lax concerning attorney advertisements. Thanks.

Only some states allow personal injury lawyers to advertise, Florida is one of those. 100x is a gross exaggeration. It’s all about competition. The more lawyers who advertise, the more NEED to advertise to get the business.

People don’t realize that the number of times you see a lawyer’s name on TV has nothing to do with his/her competence, and in fact it can be argued that GOOD lawyers don’t need to use TV advertising.

accident and personal injury lawyer courses?

Can you give me a list of some courses I should take to become a accident and personal injury lawyer?
Also, a site or two wouldn’t hurt.

You have to be a lawyer to do this. Torts and Remedies are two law school classes that would be helpful.

How To Find A Workers Compensation Lawyer

How To Choose A Workers Compensation Lawyer

If you have been involved in an accident or injury in the workplace then you may be in need of a workers compensation lawyer. First of all you need to ask yourself how serious is the problem that has been caused, if only minor then it may be possible to come to an arrangement without the need for an attorney. But if the injury that has been caused is severe or another party is starting legal proceedings then you will need to find the best compensation lawyer for your budget.

The cost of legal services can vary considerably, but even if you have very little money you can still use a good lawyer. There are firms that will offer their services for nothing until the case has been won. But be aware that there are also attorneys who will charge a few hundred dollars just for a short discussion.

If a legal expert offers you a deal were they expect no payment unless they win the case then it does not mean that they are desperate for clients, in fact it may be the opposite. It can mean that they believe you have a case that can be won.

Even if your employer has already offered you a lump sum to cover the cost of the injury it may still be worth contacting a workers compensation lawyer. It may happen that what is being proposed is very small compared to the amount of money you could receive.

Today it is not hard to find an experienced lawyer. The number of qualified attorneys is rising every year. Perhaps the best place to look is online. Most professional legal firms will have their own websites that contain information on their locality as well as fees and specializations.

If you feel that you have been unfairly made redundant or passed over for a promotion then you can also contact an employment lawyer for advice. There are now very strict laws that prevent against any form of work place discrimination.

In order to really get the answers to your question, I highly recommend you go straight to the net’s leading site about this issue here. Go there now!:

Personally, I would check the yellow book. There is usually a good amount of firms and their contact information listed there. Keep in mind, that you should look more at the firm itself than a certain lawyer.

Lawyers can come and go as they please and most sign agreements with the firm that they can not take their clients. So it is important to be comfortable with the firm as a whole (attorneys, office staff, etc.)

Good Luck

No, you don’t need a law degree and a science degree. You will have special witnesses for the technical questions. You simply need the law degree.

I want to know how do the lawyer take his percentage out of the settlement. There are three people injury in one accident so do the lawyer takes his 25% fee from each person’s settlement. My husband, son, and me got into a car accident. Do he takes out his 25% from each of our settlement or do he take one 25% out of total amount of our settlement combine?

In UK there is often a no win no fee arrangement in which case he can charge what he can get from the losing side. therefore it is not something for you to bother about and in any case the losing side pays reasonable costs which can be disputed via what is known as a taxation hearing (nothing to do with income tax) but lawyers hate them and the disputing side pays for them and both sides regard it a a bl–dy nuisance .
Each action will have an agreement with the lawyer and that will tell you if a percentage arrangement is an option or a fixed fee. It is not as unreasonable as it sounds because each claimant will have differing injuries and differing loss of earnings etc. all of which will have to be agreed or approved.
