There’s a situation at my work where large animals + certain equipment = injured employees.

Suffice to say with a bit more design savvy, the equipment could be modified to eliminate or at least reduce these types of injures. I have suggested this to my employer when I returned to work after a month off. My injury was in December. To date, nothing has been addressed.

Tell me: When does OSHA get involved with injuries that occur at work? Are they notified simply because a worker’s comp claim has been initiated? Does the injured worker have to give a heads up in order to get OSHA involved?

I’m reluctant to blow the whistle myself, but unfortunately the employer is not addressing this, and I fear someone will get seriously injured or killed one day.
ETA: can someone notify OSHA anonymously?

And it boggles my mind that OSHA wouldn’t research work-related injury, since their title is Occupational Safety and Hazards..

The worker’s comp systems and OSHA interact, but are separate. OSHA only immediately steps in if there is a fatality. OSHA does get involved when they do inspections or if someone calls them. It is up to each employer to determine the hazards in their company. So in this case, you employer has decided that the current situation the rules they have in place are satisfactory.

Now you can contact OSHA, but in this situation, your employer will probably know it is you when OSHA contacts them (see reference for OSHA contact form). You may want to do two things first. Talk to your employer again about your ideas to make things safer. Also, why they don’t change. That is info OSHA will want to know. Second, call your regional OSHA office anonymously (third reference) and talk to them.

Remember, if OSHA gets involved, your boss may get upset and retaliate against you. So make sure your work record is good and that your accident is not going to be traced back to being your fault.

They will basically claim for loss of earnings past and future and for any injuries you sustain as long as the accident was not your own fault.

You will need full hospital records and your employer records in order to stand any chance in a claim.

A customer dropped a bit of wood on my head at work(B&Q) and it has been logged in accident book. When it happened i told supervisor she gave me a smile and said u ok and that was it, few weeks later i had to go to doctor as i woke with a pain down right side of my face, vision was slightly blurry and had been overly tired. You could sue the actual person who dropped the wood on your head, instead of the company you work for.

You will have to prove the incident was the only reason for the concussion.

Can you claim for an injury caused by an accident not at work. E.g. Caused by equipment, (at a public establishment) And its likely to cause injury even when used properly as intended. I know that this specific thing has caused others injury to. Seems very inappropriate to have it really. This employee filed a claim saying he was injured on the job. We paid for him to go to the doctor. The doctor said the problem was degenerative disk disease and not caused by his work. We paid about $1,800.00 for the treatment and diagnosis and I filed an accident report with the state.

Absolutely, should it ever come up sometime, you need to explain how you thought it was work related when actually it wasn’t. I would also send a copy of the report you received from the doctor for that employee. Just put an * see attached copy for this reported item.

i worked for an insurence company we were graded on all of that stuff also, i actually hated that job, i dont think i ever hated a job like i hated that one.

I once had someone call in that had been involved in an accident, a truck jack knifed, it was carrying gas, it blew up our insured rear ended a person inforont of him that was stopped because of the explosion he was then rear ended he was on the side of the road talking on the phone out of the car and while he was talking to me his car got hit again, it SUCKED!!!!!!!!!!!!!!!

i live by myself, my job is 35 miles one way. I called boss and asked to be off until my car is fixed. Use my vacation hours until it runs out, then I will be off without pay. Normally, if the other insurance company is paying, the check will be made out to just you. If it is your company that is paying, it will be made out to both you and the body shop. If your company is paying, you can ask them to pay just you and you can then keep the money but………….. They will fight you tooth and nail on making out the check to just you. it can be done but you will be told it can’t. If you succeed, they will not pay for the same damage again and may even cancel you.

In August 2006 my car was rear-ended by another car. The driver of the other car begged me not to call the police because he had no insurance or license. He said he would pay the estimate of damage. I took my car to the dealership from which I bought it and they said it needed a new rear bumper and all that went with it for $958. The other driver agreed to make monthly $100 payments. I have the following: offender’s name, address, cell phone number, place of employment, license plate, dealership list of work performed and cost.

when he made the payments to you did he pay you cash or check, or anything with his name on it. If there is any kind of paper trail at all this could help you in court. most of the time small claims court happens real fast. it’s not like what is on TV. just take what you have and go with it. first though send a certified letter to this guy and tell him you will sue if not paid. . make sure you remind him you were doing him a favor because he had no insurance witch is illegal. good luck
