In a nutshell, I’m doing legwork for a friend who’s looking for the best lawyer in the area for a wrongful death suit against healthcare corporations. I have tried what I could think of and dig up for her, but am left with a bunch of people it seems just advertising for themselves and others in their locale and even the state bar association told me that they only recommend lawyers who have paid them to do so. Anybody can also pay the Better Business Bureau and that is how they get on that list. So is there a REAL way I can find the best lawyer for the job in this specialty in southern Wisconsin? She says she doesn’t just want her pound of flesh, she wants half the freakin cow. ?
After getting the first answer, I am really puzzled, cuz if wrongful death is too expensive a case, wouldn’t the lawyer who won the case really be reeling in the bucks?

Try this: Google "wrongful death suits" with the name of your county, Wisconsin, and click the "News" button. The articles on the cases will give you the names of the attorneys, or at least the firm. Most likely, there are one or two that win big settlements for their clients in your area. Just advise your friend to contact as many as possible and get a few opinions before she makes any decisions. (If it’s a rural area, you may have to check some neighboring counties.)

Too often, attorneys forget that they are agents for the client, and not the other way around.

The attorneys are permitted to withdraw, but only if doing so will not "prejudice" your case. In you instance, should the attorney withdraw, it could be difficult to find another lawyer. Your current lawyers will want to place a lien on any recovery you make (in other words, they would get a percentage of the eventual settlement), making another attorney reluctant to take your case. This could be prejudicial to you. They should have thought about this before taking your case. The reason they get such a high percentage fee is the risk that some cases will take a lot of time for no recovery (if they lose), or a minmal recovery even if they win.

Still, you say you need the money bad. Taking a case all the way to arbitration can take time. Further, in a wrongful death/negligence case, you are likely really talking about mediation. At a mediation, an attorney tries to get the parties to settle. They will try to bring your demand down, and the defense offer up.

But what if the case does not settle? Then you need to go on to trial. This will often result in, not only more time, but the need to retain expert witnesses. This is a very expensive proposition. Depending on the law firm, this is either "advanced" on your behalf, or you have to pay that money. In either case, you pay. At the end, the attorney would get his fee (percentage), THEN they take out their costs, and THEN they pay the subrogated insurer (medical bills and insurers paid first), and you get the rest. The attorney should negotiate these matters for you.

Still, this all take TIME. I do not know your state, or where you are in the proceedings, but negligence cases often take 18 months to 3 years from filing to resolution.

What is your time frame? When do you NEED the money. If you need the money in short order, then you will need to settle … and take a discount to do so. The highest offer (assuming your case is good) comes as you get closer to trial.

On the other hand, if your case is weak, then an insurance company will offer you "cost of defense" now. They would prefer to pay what they would otherwise pay THEIR lawyer for the CERTAINTY of no additional liability. Once you get to trial, however, most of the cost of defense will have been spent, and they merely evaluate the liability (chance they will lose) and the potential damages.

As a litigation manager for companies that do not settle without liability, I can tell you that many plaintiff lawyers are lazy. They far prefer to not work very hard, and settle for far less than a case is worth. They make money based on volume. If they can get a settlement with only 10 hours of work, it is good for them. If it takes 100 hours of work, they would need to recover 10 TIMES what they are offered early in the case to break even. If, for example, you are offered $20,000, they would need to get this up to $200,000 just to break even (from their perspective), on the eve of trial.

You need to really evaluate the case. Can you really prove that someone else was at fault? How good are your witnesses? What are your real damages? What can you prove for damages? These are all matters for serious discussion with your attorney. You are paying him to provide good, sound legal advice. You need to know what he has done to work up the case. If he has not done much, then it is too early to settle, as you cannot properly evaluate the case. He will have also shown the other side that he is not serious about working up the case for trial, and this results in a much lower settlement value.

I will try to keep this as short and sweet as possible, but it is a rather long and involved story, so please bare with me.

I have a very dear friend, who just lost his 16 year old son to cancer. (the type of which I am unsure of at the moment) The boys mother has not been involved in his life since he was 2 years old. She left him home alone, phoned the father and told him to go get his son and has not seen him since. She did pay court ordered child support, but only because she was forced to.
When the son died, my friend called her to let her know and her first response was "Good, now I can stop paying child support". Last night, a sheriff served him with papers in a wrongful death lawsuit filed by the mother, saying that his neglect led to his sons death. Needless to say, he was totally shocked and devastated. For the last 3 months, he has pretty much lived in a hospital, sitting by his sons side. He got the best medical care of him, and did everything humanly possible to ensure his son was well cared for.
My question is this, how can she sue for anything? She was never a part of the boy’s life; she wanted nothing to do with him. She never paid anything more than what she forced to. How could she even get a lawyer to take on a case like this?
I was under the impression that wrongful death would be related to something like a car accident, medical malpractice or the like. Any info you can offer would be much be very helpful.

Perhaps she believes there might have been a life insurance policy involved, and thinks she could collect from that? If that’s the case, she’s misguided, since proving negligence on the part of the father would likely excuse the insurance company from payment to anyone.

More likely, this woman is a seething, evil b*tch who wants to spread misery to all.

It behooves one to look very closely at their board of directors, what they are getting paid, what percentage goes to public education, who they interview, are they seeking the other sides arguments without predisposition, — in short, is it tabloid journalism, or is it really true. Plus, how current is it?

If there’s no will and you aren’t married you have no legal connection to him. Trying to sort out who is a casual date and who is a Life Partner is messy and difficult and the government has decided not to bother.

Without a will, the state’s Intestacy Laws take over. His sister gets to be the legal representative.

The action to be filed is called "wrongful death." There are attorneys who specialize in this kind of case. Since it will probably involve considerable investigation, you or your family should hire someone as soon as possible. The attorney will take this case on a contingency basis, and you will not have to pay unless there is an award or settlement. That settlement will be reduced by lawyer’s fees and costs.

Typically, the suit will be for the amount of insurance the other driver had. This could be anywhere from 20K to 300K. In many cases, your father’s insurance policy that cover "underinsured or uninsured" motorists, and this amount of coverage can be recovered in addition to the other driver’s insurance. In the event the other driver owns property, stocks, bank accounts and other assets, they could be attached over and above any amount of the insurance policy. Example, let’s say a jury awards your family 1M and the driver only had 300K in coverage. You could go after the driver’s assets for the rest. This could be discharged in bankruptcy, but if the driver is proven to be driving under the influence, it may not be.

The evidence/accident reconstruction will prove who was at fault. If what you say is true, there should not be a liability issue. The only issue would be the amount of settlement or award at trial. This would mean there would be a resolution sooner. If there are questions of liability…who was at fault…a trial on liability could take some time. And the attorney’s fees will be higher. These are things you and your family would need to discuss with the attorney, and the terms should be clearly outlined in the attorney’s retainer…contract…with you.

This can be a painful process. Obviously, you lost your dad, his ability to earn a living, the loss of his comfort and companionship…these are all things that are calculated when settlements or jury awards are calculated.

You need to get with an attorney as soon as your family is able to. You probably have at least a year to file the lawsuit. Your attorney will know what to do. But please do not try to resolve this on your own. It is too complicated, and you are way too emotionally involved to be objective.

the insurance company has the right to offer you any or no funds that it feels is appropriate. they have not committed any actionable offense by offering you less than you feel is warranted. Merely reject the offer, and sue the responsible party.
