I got into a serious auto accident, not my fault and totaled the new car. I haven’t been back to work as of yet and have been going to physical therapy. Can I claim anything on my taxes for 2010? Thanks!
I haven’t settled anything yet. I’m just currently still going to therapy.
No. You must have a doctors certification for permanently disabled.

There is no "disability" claim, per se, on income tax returns. If you itemize, you can claim out-of-pocket medical expenses in excess of 7.5% of AGI. That’s about all. If you’re not working and earning, you’re not paying income tax on the lost earnings anyway. If you’re collecting temporary disability, that is not taxable income either.
