is there a deadline to file an automobile accident claim?
my daughter was involved in an accident in which she was hit from behind. The other driver was at fault and admitted it and a police report was filed. Since the accident was minor she never pursued a claim. Is there a time limit for filing a claim? It has been about 6 months since that happened. I would like for her to get the car repaired.
Not to answer your question, with a question….but why did you wait so long??…Also, IMMEDIATELY contact YOUR insurance company, and ask them, about any statutes, of limitation, for claims, regarding your OWN, coverable insurance.
Your insurance company, itself, may have a deadline, to file a claim, but you should be o.k., as far as sueing the offending party, for damages….
Many insurance companies, give policyholders, a LIMITED amount of time, to file a claim….because…a fender-bender, 6 months ago, is hard to determine, if the car has been hit, or damaged, since then…they don’t want to pay any more, than they have to…..I don’t blame them, but you should report ANY accident/fender-bender, IMMEDIATELY….along with any police report.

Call the insurance company they will be able to tell you. Different states different laws.some place are up to a year some are just 24 hrs.

Some insurance companies try to penalize you for not reporting the claim within 30 days. They try to say they won’t cover you because you didn’t report it. What your daughter should do is contact the other insurance company and have them come and repair the car. You can always say you expected them to contact you. But your insurance company will give you a problem, but you were insured, so regardless you are covered. You can always appeal any decision they may try to say. Or arbitrate it. If they deny your claim, they usually provide you with information to appeal and mediate.
