The BEST way to handle this is to let your company handle the whole mess. You deductible will be returned after the claim is finalized and your company subrogates the full amount from the other company.
References :
Grizzled claims hermit

Call your insurance company and ask for the claims adjuster who is handling your claim.

My wife was a claims adjuster for years.
References :
blb is completely correct.

I was a claims adjuster for years, and some people simply feel more comfortable having their own carrier handle the repairs.

You're actually better off having his insurance company handle the claim, and here's why:

You have a contract with your insurance company. Do you think they wrote the contract with you in mind? Heck no! They wrote it to protect themselves against abuse.

You have no contract with the other guy's insurance! They have to make you happy enough to sign a release!

So go and let them make you happy!
References :
Let your insurance cover it. They'll go after his insurance company and refund you the deductible. Check it out with your agent to be sure.
References :
His insurance company should be handling the claim, plain and simple. Why your insurance company would ask such a thing to you, I have no idea. Their fault, they pay.

I have been in accidents before that were not my fault. MY insurance company dealt with the other party's insurance company and handled the whole thing. That is what they are there for, not just for claims against them (if it is a good insurance company, that is).

Call your insurance company and tell them to make sure that the opposite party pays for everything, including your rental. You should not be paying a cent. I can't see why it would be too late for their insurance company to pay. You haven't signed off anything, have you?
References :
Some people want to claim thru their own company and have them handle everything for them. If you claim thru the other company YOU are the one that needs to call the other company. As an agent in my state, I am allowed to give you lots of advice on how to handle the accident but I can't turn in the claim to the other company for you. It would be your responsibility. It is not to late to have the other persons insurance cover the accident.

I am an insurance agent and ask all clients how they want to handle the accident. I explain it the same way your agent did. He is giving you the option of how you want to handle it. If your car is driveable always go thru the other company. Don't forget to ask for a rental while your car is in the shop being fixed.
References :
Insurance agent 20+ years
